FINALLY! I have found a fix for this f**** anoying problem, that all the hotkeys do not work or do totally different things in -Edit Poly- or -Edit Mesh- mode.

Solution:

Cutimize > Customize User Interface > Group: Edit Poly --> Uncheck the "Active"-checkbox

finally using Max is fun again!
